1. Agreement to Terms

Welcome to Arenatubi! These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Arenatubi ("we," "us," or "our") regarding your access to and use of our online learning platform, including our website, mobile applications, and related services (collectively, the "Platform").

2. Description of Service

Arenatubi is an educational technology platform designed to help Kenyan students in primary and secondary schools master their studies through interactive quizzes and structured learning content. Our services include:

• Access to educational quizzes across multiple subjects
• Progress tracking and performance analytics
• Tiered learning system organized by education level and chapters
• Account management and personalized learning dashboards
• Both free and premium subscription plans

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice.

3. Eligibility and Account Registration

3.1 Eligibility

To use Arenatubi, you must:

• Be at least 13 years old, OR have parental/guardian consent if under 13
• Provide accurate and complete registration information
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable law

3.2 Account Security

When you create an account with Arenatubi, you agree to:

• Provide truthful, accurate, and complete information
• Maintain the security and confidentiality of your password
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with others

3.3 Parental Consent

If you are under 13 years old, your parent or legal guardian must consent to these Terms and supervise your use of Arenatubi. Parents/guardians are responsible for monitoring their child's online activities.

4. Acceptable Use Policy

When using Arenatubi, you agree NOT to:

• Violate Laws: Use the Platform for any illegal or unauthorized purpose
• Cheat: Share quiz answers, use unauthorized assistance, or engage in academic dishonesty
• Hack or Exploit: Attempt to gain unauthorized access to our systems or other users' accounts
• Distribute Malware: Upload viruses, malware, or any harmful code
• Harass Others: Engage in harassment, bullying, or threatening behavior
• Impersonate: Pretend to be another person or organization
• Scrape Data: Use automated tools to collect data from our Platform without permission
• Reverse Engineer: Attempt to copy, modify, or reverse engineer our technology
• Spam: Send unsolicited communications or advertisements
• Misuse Content: Reproduce, distribute, or sell our educational content without authorization

5. Intellectual Property Rights

5.1 Our Content

All content on Arenatubi, including but not limited to quizzes, questions, images, text, graphics, logos, software, and platform features, is the exclusive property of Arenatubi or our licensors and is protected by Kenyan and international copyright, trademark, and intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Arenatubi for personal, non-commercial educational purposes only. You may NOT:

• Copy, modify, or create derivative works from our content
• Sell, rent, lease, or sublicense our content
• Use our content for commercial purposes
• Remove copyright or proprietary notices from our content

5.3 User Content

By submitting feedback, suggestions, or other content to Arenatubi, you grant us a worldwide, royalty-free, perpetual license to use, modify, and incorporate that content into our Platform.

6. Subscription and Payment Terms

6.1 Free and Premium Plans

Arenatubi offers both free and premium subscription plans. Premium features may include unlimited access to all subjects, advanced analytics, and additional learning tools.

6.2 Payment

• Premium subscriptions require payment of applicable fees
• All fees are in Kenyan Shillings (KES) unless otherwise stated
• Fees are billed in advance on a monthly, quarterly, or annual basis
• Payment must be made through our authorized payment providers
• We reserve the right to change our pricing with 30 days' notice

6.3 Refunds

Subscription fees are generally non-refundable. However, we may offer refunds on a case-by-case basis at our sole discretion. Contact our support team if you believe you are entitled to a refund.

6.4 Cancellation

You may cancel your premium subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. No partial refunds will be provided for unused portions of a subscription term.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Arenatubi, you consent to our data practices as described in the Privacy Policy.

8. Disclaimers and Limitations of Liability

8.3 Limitation of Liability

To the maximum extent permitted by law, Arenatubi shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data or academic progress
• Loss of profits or revenue
• Poor exam performance or academic results
• Unauthorized access to your account
• Technical errors or platform downtime

Our total liability to you for any claim arising from your use of Arenatubi shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Arenatubi, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of the Platform
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in your profile settings.

10.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended inactivity
• Any reason at our sole discretion

10.3 Effect of Termination

Upon termination, your right to use Arenatubi will immediately cease. We may delete your account data in accordance with our data retention policies. Provisions of these Terms that should survive termination (including intellectual property rights, disclaimers, and limitations of liability) will remain in effect.

11. Dispute Resolution and Governing Law

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

11.2 Dispute Resolution

In the event of any dispute arising from these Terms or your use of Arenatubi:

1. Informal Resolution: First, contact us at support@arenatubi.com to attempt to resolve the matter informally
2. Mediation: If informal resolution fails, we agree to pursue mediation before resorting to litigation
3. Jurisdiction: Any legal action must be brought in the courts of Kenya

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or platform notification for material changes
• Provide you with the opportunity to review the updated Terms

Your continued use of Arenatubi after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using our Platform.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arenatubi regarding your use of the Platform.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor or affiliate without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, internet outages, or government restrictions.
